In a significant development, the Jammu and Kashmir Police have initiated the attachment of a two-storey house and adjacent land owned by Mian Abdul Qayoom, the former President of the Jammu and Kashmir Bar Association. This action is based on the provisions outlined in the Unlawful Activities (Prevention) Act (UAPA). Within the order issued from the Police Headquarters, the police highlighted that the decision stems from FIR No. 157/2009, which was registered at the Shaheed Gunj police station. The FIR involves various charges under the Indian Penal Code as well as sections of the UAPA, arising from a seminar conducted on December 31, 2009. The seminar, which commemorated the death anniversary of Ali Mohammad Jinnah, was reportedly attended by several separatist leaders, including Mian Abdul Qayoom himself, along with notable figures like Aasia Andrabi and Shabir Ahmad Najar.
Investigations revealed that the event featured speeches that were deemed to be anti-India, encouraging the secession of Jammu and Kashmir and advocating for the imposition of Islamic law. Eyewitness accounts collected during the police investigation confirmed that participants engaged in inflammatory rhetoric, inciting the audience against the sovereignty of India. Following these allegations, police executed searches at Qayoom's residence in Barzulla, Srinagar, under judicial authority, which resulted in the recovery of significant incriminating materials. Among the confiscated items were literature that is prohibited, blank letterheads associated with the designated terrorist organization Hizbul Mujahideen, as well as seal impressions and a controversial letter addressed to the then U.S. President Bill Clinton from Hizbul Mujahideen chief Syed Salahuddin.
The investigators have concluded that Mian Abdul Qayoom utilized his residential property, which encompasses a two-storey structure and approximately 2 kanals, 1 marla, and 90 square feet of land to conceal materials that support terrorist activities. As per the Unlawful Activities (Prevention) Act's description of 'proceeds of terrorism,' this property falls within its legal definitions. In light of the findings, the Director General of Police has authorized the attachment of the property located in Bulbul Bagh, Barzulla, Srinagar, executing powers vested in him under Section 25 of the UAPA. This action reflects the ongoing efforts of law enforcement to combat terrorism and illegal activities in the region, holding individuals accountable for actions that threaten national integrity.
